Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Txtivo ("the Service"), you agree to be bound by these Terms of Service. These Terms constitute a binding legal agreement between you and Txtivo, operating under the laws of Nepal.

2. Account Registration

  • You must be at least 18 years old to use the Service.
  • You are responsible for maintaining the confidentiality of your credentials.
  • True Information: You agree to provide accurate, current, and complete information during the registration and A2P vetting process. Providing false business information (e.g., fake EIN/PAN) is a violation of these terms.

3. A2P 10DLC Compliance & Carrier Restrictions

Txtivo strictly adheres to compliance rules set by US Carriers (AT&T, T-Mobile, Verizon) and The Campaign Registry.

  • Prohibited Content: You may NOT use Txtivo to send messages related to high-risk financial services, debt collection, "get rich quick" schemes, illegal substances (Cannabis/CBD), gambling, or hate speech.
  • Opt-In Requirement: You acknowledge that you have obtained prior express written consent (opt-in) from all recipients. Cold-texting purchased lists is strictly prohibited.
  • Fines: If your traffic results in fines from carriers (e.g., for spam or SHAFT violations), you agree that Txtivo may pass these fines directly to you, and we may deduct them from your Wallet balance.

4. Fees and Payments

  • Wallet Credits: Usage of SMS, Voice, and Email is deducted from your prepaid "Wallet Balance."
  • No Refunds: Wallet credits and Subscription fees are non-refundable, except where required by law.
  • Auto-Recharge: If enabled, your payment method will be charged automatically when balances fall below your set threshold.

5. Termination

We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms (specifically the A2P Compliance section).

6. Limitation of Liability

To the maximum extent permitted by law, Txtivo shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the last 12 months.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any dispute arising from these Terms shall be resolved exclusively in the courts located in Kathmandu, Nepal.
